LEGAL NOTICE, TERMS OF SERVICE & SALES CONDITIONS

2. Purpose

These Legal Notice, Terms of Service and Sales Conditions (the “Terms”) govern access to and use of the Platform and define the conditions under which COVER AR provides its subscription services and equipment rental services.

By accessing the Platform or subscribing to the services, the user confirms that they have read, understood, and accepted these Terms without reservation.

3. Services

The Platform provides access to the COVER AR application and client dashboard, available exclusively through subscription.

COVER AR offers monthly and annual subscription plans granting access to the application and client portal.

COVER AR may also offer hardware rental services (including iPad tablets) to optimize service usage. Equipment rental requires payment of a security deposit, the amount of which depends on the model rented.

4. Pricing and Payment

Subscription and rental fees are displayed in euros (€), excluding or including VAT depending on applicable regulations.

COVER AR reserves the right to modify pricing at any time. The applicable price is the one in effect at the time of subscription or renewal.

Payments are processed exclusively via credit or debit card through Stripe’s secure payment system. By subscribing, the customer agrees to Stripe’s contractual terms.

Subscriptions are entered into for an initial period of one (1) month or twelve (12) months depending on the selected plan and renew automatically for identical periods unless canceled before renewal. Cancellation takes effect at the end of the current billing period and does not entitle the customer to any prorated refund.

5. Equipment Rental

Rental agreements have no mandatory minimum duration.

A security deposit is required at the time of subscription. This deposit does not accrue interest and will be refunded at the end of the contract, subject to the equipment being returned in proper working condition.

The equipment remains the exclusive property of COVER AR throughout the rental period.

In the event of loss, theft, or damage, COVER AR reserves the right to retain all or part of the deposit.

COVER AR may replace equipment with an equivalent or newer model if deemed necessary.

6. No Right of Withdrawal

The services provided by COVER AR are exclusively intended for business users (B2B).

Therefore, no statutory consumer withdrawal right applies.

7. Intellectual Property

All elements of the Platform, including software, interfaces, databases, trademarks, logos, texts, images, and videos, are the exclusive property of COVER AR.

Any reproduction, modification, distribution, or unauthorized use is strictly prohibited.

8. Liability

COVER AR makes reasonable efforts to ensure service availability but does not guarantee uninterrupted access.

COVER AR shall not be liable for temporary service interruptions, maintenance downtime, third-party disruptions, force majeure events, or user misuse.

To the fullest extent permitted by applicable law, COVER AR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from the use of the Platform.

9. Termination

COVER AR reserves the right to suspend or terminate access in case of material breach, including non-payment or misuse.

Termination does not entitle the customer to any refund of previously paid amounts.

10. Governing Law and Jurisdiction

These Terms are governed by French law.

Any dispute shall fall under the exclusive jurisdiction of the competent courts of Rouen, France.

Users outside France expressly accept the application of French law and jurisdiction.

11. International Users

The Platform is operated from France.

If you access the services from outside France, including from the United States, United Kingdom, or Canada, you acknowledge that your data may be transferred to and processed in France and the European Union.

By using the services, you consent to such transfers in accordance with applicable data protection laws.
